Subrogation is one of the rights that an insurance company may have either under the terms of its insurance contract with its insured or under a separate agreement with the insured. A right to subrogate permits the insurance company to stand in the place of its insured and to seek recovery of the sums the insurer paid to its insured from a third party.
An insurance company retains our firm to handle the recovery from the third party. If necessary, we file a lawsuit on behalf of the insurance company and against the third party to obtain a judgment. At other times, we enter into an agreement for repayment with the third party on behalf of the insurance company. Then, we collect the money owed to the insurance company and peridoically remit the net funds collected to the insurance company.
